Notary Public – What are they?

Most people don’t know what a Notary Public is until they are told by a foreign lawyer that they need something notarised for use overseas.

Emma Sykes, of Bryan and Armstrong Solicitors, is a solicitor and Notary Public – so what exactly is one and what do they do?

It’s a question that is often asked. All Notaries are lawyers, who have undertaken further qualifications in the form a two year post graduate course, in order to qualify as a Notary. Some, like Emma, are also qualified solicitors

Notaries are a very niche branch of the legal profession. There are only around 850 Notaries in England and Wales, with few being dual-qualified.

When companies and individuals contact a notary public, they often ask if their usual solicitor can deal with matters for them. No is normally the answer, why?

A solicitor can only deal with matters of English law. A Notary can intervene in matters worldwide. They have global jurisdiction to verify and authenticate events, facts, documents, people and their authority all across the world. Emma’s signature is registered with the Foreign and Commonwealth and with different embassies worldwide.

Who might need a notary?

Both companies and individuals might require the services of a Notary. A Notary prepares, witnesses and/or certifies documents going abroad. The most common tasks are:

  • Authenticating copies of company documents/transactions (such as Board Minutes, Company Resolutions, Companies House Incorporation documents, Change of Name, Articles of Association to name a few!)
  • Preparing certificates as to a Companies status, or to identify the directors, and their authority.
  • Preparing and witnessing powers of attorneys for use overseas
  • Dealing with purchase or sale of land and property abroad.
  • Authentication personal documents (such as degree certification, information for immigration or emigration purposes, or to apply to marry and work abroad)
  • Consent forms for minors to travel abroad
  • Proof of life forms
